Virginia Obstruction of Justice Laws

Virginia Obstruction of Justice Laws can be found in Chapter 10, Article 6 of Title 18.2 of the Virginia Code (Virginia Code 18.2-460).

However, it’s crucial to note that framing “Obstruction of Justice” as just one type of charge is misleading. Rather, in Virginia Code 18.2-460, there are actually five subsections that address Obstruction of Justice:

(1) Subsection A addresses Obstruction of Justice generally;

(2) Subsection B and C handle Obstruction of Justice by threat or force;

(3) Subsection D addresses Obstruction of Justice through lying; and

(4) Subsection E addresses Obstruction of Justice through resisting arrest.

Notably, in this Obstruction of Justice statute, only one of these subsections charges Obstruction as a felony–Subsection C–and the remaining subsections are classified as misdemeanors. Importantly, the misdemeanors are classified as Class 1 misdemeanors, which is significant and should be taken seriously.
